The Anti-Corruption Unit chief vowed yesterday that his office would make a high-profile arrest in coming weeks related to an ongoing investigation at the Preah Vihear Provincial Court.

Speaking at a press conference at the Sofitel hotel in Phnom Penh, ACU president Om Yentieng said the arrest of an unnamed deputy prosecutor for allegations relating to bribery and the freeing of a “perpetrator” was forthcoming.

“The case of the Preah Vihear provincial deputy prosecutor was among 800 complaints [we received],” he said, adding that the arrest could be made as early as next week.

The hundreds of complaints referred to arrived in the office from January to August this year. Although this is the only impending arrest, Yentieng said that about 30 per cent of the complaints were credible enough to deserve an investigation.

Yet another alleged trafficker with suspected links to a Thai drug ring was arrested at Siem Reap airport on Wednesday, this one with more than five kilograms of methamphetamine, police said yesterday.

Nuon Sophanny, chief of the Siem Reap Provincial Anti-Drug Police Department, said that Thai national Inthanu Suphee, 42, was arrested in the airport by anti-drug forces collaborating with immigration and customs officers while allegedly attempting to transport 5.6 kilograms of crystal meth, originally from India, to Thailand.

At least seven other accused traffickers with suspected connections to Thai syndicates have been arrested in Cambodian airports in the past two months.

“She was a member of an international network of traffickers hiding in Thailand,” Sophanny said.

“She had brought the drugs from India to Cambodia via a transfer from Malaysia’s Kuala Lumpur airport to Siem Reap.”

“She was arrested by police after they found and seized many packages of drugs hidden inside spools of thread in her luggage,” he added.

According to Sophanny, the suspect is being held for further investigation and will be sent to court today to be officially charged.

Police have seized more than 30 kilograms of methamphetamine and cocaine in August, in a string of airport arrests believed to be related to international drug traffickers based in Thailand.

Khieu Saman, director of anti-drug police at the Ministry of Interior, noting the string of recent arrests and seizures, lauded Wednesday’s bust.

“This is a big success, that our Cambodian police have prevented international drug smuggling and have cracked down on it in Cambodia,” he said.

Most mornings, garment worker Vicheka buys food from the street vendors outside her factory in Kampong Chhnang province. The beef and pork dishes, she says, have a tendency to give workers a stomach ache – a reputation forged long before Vicheka and her co-workers at the M&V factory fainted on the job this month.

It’s not unusual for the food to spend hours in the sun’s searing heat. More often than not, it’s unhygienic and it always tastes bad.

Its allure, however, is that it’s cheap.

“I make a low wage,” the 20-year-old, who has been working in the factory making clothing for H&M for three years, says. “I simply can’t spend money on good food. It’s too expensive.”

Rights group urge changes to ASEAN Human Rights declaration

Regional women’s rights groups called on Foreign Minister Hor Namhong to press for substantive changes to a highly criticised draft of the ASEAN Human Rights Declaration.

Namhong is scheduled to meet his ASEAN counterparts in New York this morning to review the draft declaration.

Chief among the changes suggested by the Southeast Asia Women’s Caucus on ASEAN is that a controversial public-morality clause be struck.

“Its application has been based on the dominant patriarchal and religious hierarchies, and has been targeting the rights of women and girls,” the letter reads.

The group also asked that the draft be presented for public consideration. While a copy was leaked last month, officials haven’t publicly released it.

Union boss faces charges for inciting strike

he president of the Cambodian Confederation of Unions Rong Chhun appeared in Kandal Provincial Court for nearly three hours yesterday, fielding questions stemming from accusations of incitement and defamation, the union boss said.

According to Chhun, his appearance was related to a complaint alleging that he had incited workers to strike, and had defamed the management of the Tai Yang Enterprise garment factory – whose leadership filed the complaint against him after his involvement in a two-month strike that began in late June.

“I told the prosecutor that what the company accused me of is different [from what I did],” said Chhun, who has maintained his participation in the strike was not his idea.

Boeung Kak Lake developer makes moves

After months of inactivity that has fuelled questions about the company’s future, Boeung Kak lake developer Shukaku Inc has launched a recruitment drive, calling for at least half a dozen architects, engineers and other employees.

For months, all has been quiet at the filled-in lake from which thousands have been controversially evicted in recent years. Although the silence has raised questions over the future of the large-scale development, recent job advertisements seem to indicate the project remains on track.

Classifieds that sprang up on the employment website overseasjobs.com last week encourage foreign workers – preferably those who speak Chinese and English – to apply for positions including planning director, head of administration and senior business development manager.

Land title deals for former Khmer Rouge in question

Former Khmer Rouge cadres who in return for laying down their weapons and swearing allegiance to the Cambodian government were granted plots of land in what is now Kampot province say local authorities aren’t respecting the deal.

Representatives of 80 families in the province’s Chhouk district told the Post yesterday that land officials are staking out the area to make room for newcomers, even after they submitted proof of ownership documents.

“The authority in Kampot’s Chhouk district doesn’t recognise our land possession,” said Touch Hoeung, an ex-cadre who lived in the area from 1975 until 1996, when he and thousands of others began to defect to the government in a disarmament that carried on for the next few years.

While protesters demonstrated outside, urging land and human-rights reform, members of the donor community met with the government yesterday at the Council for the Development of Cambodia in Phnom Penh to sign off on a series of development targets that bore only a faint resemblance to those recommended by civil society.

The high-level donor meeting typically convenes every six months, but had been indefinitely postponed since April, 2011.

At the meeting, donors and the government agree to targets that help inform aid packages.

Local and international NGOs have been urging foreign nations to withhold aid unless strict human-rights reforms are made by the government, but donors neither pledged nor suspended funds yesterday.

Instead, reading from a series of prepared speeches, most offered only the most cautious of critiques, such as a suggestion by Japan that civil society opinion be sought more often and the EU’s calls for increased budget transparency.

More than 100 NGOs and human rights groups yesterday urged foreign donors to flag issues regarding land policies, democratic processes and human rights during today’s Government-Development Partner Coordinating Committee (GDCC) meeting.

While the high-level aid conference was once held every six months, today’s meeting marks the first GDCC since April last year after the government indefinitely suspended it in August 2011.

Intended as a preparatory meeting for Cambodia’s main government and donor summit, the GDCC is generally used by the government to provide an indication of where its five-year plan is headed. That, in turn, is meant to inform donor policy in the lead-up to the Cambodian Development Cooperation Forum (CDCF), in which donors typically reveal where aid funding will be channelled and identify reforms they expect the government to tackle.

Villagers face eviction again in Phnom Penh

Villagers evicted from the former Sambok Chab community in the capital’s Dangkor district in 2006 face eviction for the second time – this time without any compensation, evictees told the Post yesterday.

According to villager Heng Pheng Chun, 26, authorities in Por Sen Chey district have issued letters to 19 families in Kork Roka commune’s Andong village, informing them their houses must be torn down by October 3 to make way for a new road.

“In the letter, it said that if we have not torn down our homes by then, they will take action against us and will not be held responsible for any property loss,” he said, adding that he had relocated to Andong village as instructed by authorities.

“They have forced us out of one town already, so where am I supposed to go? There is no justice for poor people like me.”

The Phnom Penh municipal authority deployed police forces equipped with electric shock batons and shields to force 1,554 families from their homes in Sambok Chab in 2006.

A pair of reports to be presented at the UN Human Rights Council in Geneva today and tomorrow paint a bleak image of a country whose rights record has worsened considerably over the past year.

An annual report from the Office for the High Commissioner of Human Rights (OHCHR) in Cambodia, due to be presented on Wednesday, highlights crackdowns on freedom of expression, an increasing desperation over land issues and a culture of impunity that has hardly abated.

Special rapporteur Surya Subedi’s annual report, meanwhile, which was published late last month and details the high “human cost” of land concessions, will be delivered today.

A number of government and NGO reports will also be heard over the next two days during the 21st session of the council, at which Cambodian expatriates and rights defenders plan to stage demonstrations.

Sao Sareoun and Ly Chanary, the two land-rights activists arrested outside the three-hour trial of 13 women from Boeung Kak lake in May, hope an easing of bail conditions is a sign authorities are planning to drop charges against them.

The Court of Appeal yesterday ruled that the pair no longer had to report to authorities once a fortnight – a condition of their release from pre-trial detention at Prey Sar prison in mid-June.

“The [court] has allowed us to report to authorities once a month rather than twice a month like before,” Sareoun said.

“They’ve done this so our incomes aren’t affected as much when we report to them.”

The pair, who have been charged with occupying state land and obstructing public officials in aggravating circumstances – the same charges as the 13 women – were arrested as they arrived at the Phnom Penh Municipal Court on May 24 to act as witnesses for the women, who were being tried without a lawyer.

Those women were sentenced to two and a half years in prison, but were released on appeal on June 27, although their convictions remain.

Witness testimonies conflict at Mam Sonando trial

Testimony continued in the case of jailed Beehive Radio director Mam Sonando and his alleged accomplices yesterday at the Phnom Penh Municipal Court, with 12 witnesses alternately accusing and absolving the Association of Democrats president and his co-defendants.

About 200 protestors camped outside the court again yesterday, however, despite an omniscient police force, the atmosphere was calmer with protestors singing and chanting peacefully throughout the day.

Unlike the first day of trial, media were allowed inside the court room to observe the proceedings.

Several of the prosecution’s witnesses said that their testimony was based entirely on hearsay, and none had any evidence to offer about the men actually on trial, focusing instead on alleged co-conspirator Bun Ratha, whose whereabouts have been unknown since the fatal May eviction in Kratie province’s Pro Ma village that spurred the charges of “secessionism” in the first place.

Land activists continue petitioning

Free of the police resistance that thwarted their march the previous day, about 65 Borei Keila and Boeung Kak community supporters marched to the Ministry of Justice yesterday in another effort to have land dispute activists Tim Sakmony and Yorm Bopha freed from pre-trial detention at Prey Sar prison.

“We need justice,” the residents chanted as tourists at the nearby Royal Palace looked on. Bopha was arrested last week and charged with intentional violence.

Motodop group Cambodia for Confederation Development Association members have said the 29-year-old was involved in beating two motodops at Boeung Kak lake.

Nine witnesses including two defendants who had previously cut immunity deals with the government — took the stand yesterday to testify against Mam Sonando, the jailed Beehive Radio director and president of the rights-education group Association of Democrats.

Speaking at the hearing, Lou Rabo, a deputy at the Internal Security Department of the Ministry of Interior, said investigations into Sonando’s activities outside Cambodia had revealed meetings in the US and Thailand with America-based dissenter Sourn Serey Ratha, whose Khmer People Power Movement recently filed a complaint with the International Criminal Court accusing the Cambodian government of crimes against humanity.

Testimony continued in the case of jailed Beehive Radio director Mam Sonando and his alleged accomplices yesterday at the Phnom Penh Municipal Court, with 12 witnesses alternately accusing and absolving the Association of Democrats president and his co-defendants.

About 200 protestors camped outside the court again yesterday, however, despite an omniscient police force, the atmosphere was calmer with protestors singing and chanting peacefully throughout the day.

Unlike the first day of trial, media were allowed inside the court room to observe the proceedings.

Several of the prosecution’s witnesses said that their testimony was based entirely on hearsay, and none had any evidence to offer about the men actually on trial, focusing instead on alleged co-conspirator Bun Ratha, whose whereabouts have been unknown since the fatal May eviction in Kratie province’s Pro Ma village that spurred the charges of “secessionism” in the first place.

Borei Keila protesters, including many who live in squalor under staircases at the site, have already been compensated for losing their homes and have no right to demand more, Suy Sophan, the owner of developer Phan Imex, told the Post yesterday.

About 200 supporters from the Borei Keila and Boeung Kak lake communities gathered yesterday, praying at a pagoda nearby Prey Sar prison for the release of the representatives.

Boeung Kak lake’s Yorm Bopha and Tim Sakmony from Borei Keila were arrested in separate incidents last week.

Cambodia’s courts were being used as weapons in the government’s quest to silence land protesters, right groups claimed yesterday.

Licadho, Equitable Cambodia and the Housing Rights Task Force were among a coalition of NGOs to condemn the pre-trial detention of Yorm Bopha and Tim Sakmony, who were locked in Prey Sar prison this week after being charged in the Phnom Penh Municipal Court.

“Ever increasing is the use of criminalisation and pre-trial detention to silence the decent voices of victimised communities, their representatives and human-rights defenders,” Yeng Virak, executive director of the Community Legal Education Centre, said.

“This is a systematic, repeated and consistent tactic that is in violation of the fundamental and constitutional rights of all Cambodians.”

Complaint to ADB cites decline in housing, food, education

Families have fallen into poverty and children have dropped out of school due to deficiencies in the Asian Development Bank’s rehabilitation of Cambodia’s railway system, according to a complaint filed to the bank’s compliance review department.

According to David Pred, managing associate for NGO Inclusive Development International, families forced to relocate to make way for the project had lodged the complaint to ADB’s Compliance Review Panel, claiming ADB had undercut families and the project had left many unable to provide for their families.

A 65-year-old woman who has spent months sleeping under a staircase at Borei Keila yesterday became the second land-rights activist sent to Prey Sar prison in little more than 24 hours.

Phnom Penh Municipal Court investigating judge Ly Leabmeng questioned villager representative Tim Sakmony for almost five hours before charging her with incitement and ordering her to be locked in pre-trial detention, her defence team said.

“This court doesn’t offer any justice for the poor,” fellow Borei Keila resident Ath Samnang, one of about 100 supporters outside the court, said as she watched her friend being driven off in the direction of Prey Sar.

The jailing of Sakmony, who was summonsed last week after an incitement complaint by Suy Sophan, the owner of Borei Keila developer Phan Imex, came one day after Boeung Kak village representative Yorm Bopha was detained and jailed on charges of intentional violence.

Prime Minister Hun Sen will personally deliver land titles to residents in Kratie province’s Snuol district on September 21 following the completion of the land measuring mission by volunteer youth there.

“I will go to Kratie’s Snuol district to distribute land titles for these residents for the first time. They are not provisional but complete land titles for ownership,” Hun Sen said during a graduation ceremony held at Koh Pich yesterday.

The Phnom Penh Municipal Court had summonsed 40 people to face charges and serve as witnesses in the trial of jailed Beehive Radio director Mam Sonando, slated to begin next week, a court official said yesterday.

According to deputy prosecutor Meas Chanpiseth, the summonses were issued last month calling on the host of participants to appear on Tuesday, September 11 to offer evidence – or, in some cases, to face accusations – relating to the alleged “secessionist” plot in Kratie province that Sonando has been accused of masterminding.

Prominent Boeung Kak villager and protester Yorm Bopha was yesterday jailed in Phnom Penh’s Prey Sar prison, after she and her husband – en route to check for their names on a voting register – were pounced on by police in plain clothes in what her husband claims was a set-up.

Outside a building housing Srah Chork commune’s electoral roll, 29-year-old Bopha and her 56-year-old husband Lous Sakhorn were arrested at about 9am by 10 policemen, who shoved them into an unmarked car and sped away, according to witness Doung Kea.
